They tell you to write to the school citing regulation 8(1)(d) of the Education (Pupil Registration) (England) Regulations 2006. Those Regulations were revoked on 19 August 2024. That regulation does not exist. Council leaflets still quote it. So do home education groups, and solicitors' blog posts nobody has updated.

This book quotes the live one instead, in full, and shows you the letter that uses it.

And something is coming. The Children's Wellbeing and Schools Act 2026 received Royal Assent on 29 April 2026. It creates a compulsory register of children not in school, a consent gate for withdrawing certain children from school, and a tougher attendance order process. The internet is currently full of people frightening parents about rules that are not yet in force.

This book keeps those two things strictly apart, on every page: what binds you today, and what is coming.

Which letter you have actually had. Most letters parents receive are informal enquiries carrying no duty to reply. A section 437 notice is a different animal with a minimum fifteen day clock. Telling them apart is the most useful skill in this book.

England. Education is devolved and Scotland, Wales and Northern Ireland have different law. In Scotland you very often do need consent, under a different Act entirely, and a parent acting on an English book would be acting on the wrong law. This book says so.
